DUpload is committed to complying with U.S. copyright law and responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA)
DMCA Compliance
DUpload is an Online Service Provider under Title II of the Digital Millennium Copyright Act, 17 U.S.C. Section 512 ("DMCA"). This document outlines our policy for implementing notice and takedown procedures as required by DMCA.
DUpload complies with industry standards in copyright law and responds promptly to claims of copyright infringement reported to our designated copyright agent. We will disable access to or remove content that we believe in good faith may infringe copyrights of third parties.
Our Policies
1. Absence of Index
DUpload is technically unable to index the content being uploaded or stored on our servers.
2. Content Privacy
DUpload considers all uploaded content to be private and confidential unless the user makes it publicly available.
3. No Content Judgment
Without a distinct copyright owner notification, DUpload has no authority to determine whether:
- A user is authorized to upload specific content
- The content is being used for personal purposes
- The copyright has expired
- The content qualifies as fair use
All content is considered consistent with our Terms of Service unless notified otherwise by the copyright owner.
Submitting a DMCA Notice
To submit a valid DMCA Notice, please include the following information:
- Identification of yourself as the owner of the copyrighted work, or a person authorized to act on behalf of the owner
- Your physical or electronic signature
- Identification of the copyrighted work you believe is being infringed
- Identification of the material you claim is infringing, including specific URLs on DUpload where the material is located
- Your contact information including name, address, phone number, and email address
- A statement that you have "a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law"
- A statement that the information in your notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
Notice and Takedown Procedure
When we receive a proper DMCA notification or otherwise become aware that copyright rights are being infringed, we will remove or disable access to the infringing materials as soon as possible. You do not need to wait for confirmation from us about this action.
Counter Notification
If you believe your content was mistakenly removed due to a misidentification, you may submit a counter-notification containing:
- Your physical or electronic signature
- Identification of the removed material and its location before removal
- A statement under penalty of perjury that you believe the material was removed by mistake
- Your name, address, and telephone number
- A statement consenting to jurisdiction in Federal District Court
Additional Information
All messages, including takedown notices, must be sent as plain text. Attachments will not be opened unless specifically requested by our team due to security concerns.
